Saudi Authorized Representative and MDMA: Is Appointing an Agent Enough?
Understand the difference between an authorized representative, product marketing authorization and importer or distributor licensing.
“We already have a local agent. Do we still need product registration?” This is a common question when planning Saudi market entry.
Serena's first question is: what kind of agent? Commercial distribution, regulatory representation and product authorization are different arrangements.
1. Representation is not product authorization
- Authorized representative (AR): acts under a foreign manufacturer's written mandate to perform relevant regulatory duties in Saudi Arabia and must hold the applicable SFDA licence.
- Medical Device Marketing Authorization (MDMA): concerns product market access. An AR licence or agency contract does not replace it.
- Importer or distributor: carries out import or distribution activities and must meet the requirements applicable to those activities.
One company may perform multiple roles, but each role has its own requirements. For normal commercial market entry, check the applicable MDMA requirements. Special-purpose imports or exemptions need separate assessment. SFDA marketing authorization requirements
2. Four checks before signing
- Licence: Does the proposed AR hold a valid, applicable licence, rather than only a commercial registration or distribution qualification?
- Mandate: Are the manufacturer, product scope and responsibilities clearly defined? A sales agreement alone is not enough.
- Product coverage: Do the models, intended purpose and manufacturer details match the application documents and authorization scope?
- Maintenance: Who handles product changes, safety issues, regulatory communications and document handover?
Agree these arrangements before shipment or customer due diligence exposes a gap. SFDA manufacturer–AR agreement template
3. Does CE marking replace Saudi authorization?
No. CE marking is not a substitute for MDMA. Existing conformity documentation can support an assessment, but Saudi requirements still need to be addressed. Appointing an AR does not transfer all product-compliance responsibility away from the manufacturer. SFDA requirements
4. Start with the product and the proposed roles
Prepare product images, intended purpose, model list, manufacturer details, existing compliance documents and any Saudi agency or distribution arrangements.
We can help clarify how representation, the product application and import or distribution arrangements fit together, reducing avoidable rework.
